Understanding and addressing conflicts of interest is an essential aspect of legal practice, whether you’re a solo practitioner or part of a large firm. Attorneys frequently face ethical dilemmas involving new and existing clients, requiring a clear understanding of professional responsibilities. The American Bar Association’s Model Rules of Professional Conduct, widely implemented across states, offer essential guidance to navigate these situations effectively.
This CLE course provides a deep dive into the ethical principles surrounding conflicts of interest. Topics include confidentiality of client information, the scope of representation, managing relationships with current and former clients, the imputation of conflicts within a firm, and ethical considerations when declining or ending representation. Additional focus is given to trial advocacy, communicating with represented individuals, client capacity, and ethical promotion of legal services.
