About This Course
This CLE course provides an overview of the criteria courts use to evaluate disclosure requests in special proceedings under CPLR 408. Unlike standard cases, disclosure in special proceedings is not automatically permitted, except for a notice to admit.
To obtain disclosure, a party must file a motion under CPLR 408 and demonstrate “ample need.” Since this standard is not precisely defined, the course will examine how different courts interpret and apply it when ruling on motions for disclosure in special proceedings.
