About This Course
The Federal Rules of Civil Procedure, particularly Rules 26–37, are crafted to ensure equitable and effective litigation by facilitating discovery that reveals evidence supporting or challenging parties’ claims and defenses. Regrettably, many lawyers hinder this goal by routinely issuing a flood of objections to discovery requests, often coupled with unclear disclaimers like “subject to and without waiving the foregoing objections.”
This CLE session delves into pivotal case law shaping these discovery rules, arms participants with actionable techniques for preparing precise and rule-compliant discovery responses, and offers methods to address and overcome opposing counsel’s inappropriate objections, preserving the discovery process’s fairness and efficiency.
