Gwen Hewitt, Esq.
Since 1995 Gwen Hewitt has been helping people with their money issues, advising individuals on how to manage their finances better. From taxation issues, to social security, bankruptcy, evictions, garnishments, judgments, foreclosures, tax sale, tax assessment appeals and tax collections, Gwen Hewitt has helped thousands of clients resolve their money problems.
Gwen Hewitt Law was established in 2008 after Ms. Hewitt started her own law practice after many years of working as an in house government attorney.
Ms. Hewitt is pleased to offer the following thoughts on debt issues. Often bankruptcy is a good choice.
Chapter 13 or wage earner bankruptcy is helpful when someone is behind on payments on their house or car and want to keep this property. Chapter 13 can also be used to prevent an eviction if a person wants to stay in a rental property. (This is complicated: be sure to discuss with an attorney). A Chapter 13 bankruptcy plan is funded by wage garnishment through the court and lasts five (5) years. It pays back the arrearage (back money owed) and reduces the amount paid to other (unsecured) bills.
Chapter 7 or straight bankruptcy is often best used when a person has a lot of debt and he or she just can not get out of with monthly payments. A Chapter 7 bankruptcy usually takes four (4) months from filing to discharge. Costs associated with a Chapter 7 are: attorney fee, court costs, and two certificate fees.
Social Security and Disability cases to obtain government aid are rising. These cases can be complicated. Individuals can usually expect to be turned down on their first application. Often success is improved when an attorney takes on the case and helps with the organization and presentation of the issues. Social Security cases can take up to three years to be resolved. Individuals hoping for social security need to understand that it is not a fast process. But, the sooner an attorney starts to help you, then the probably of receiving benefits sooner is increased.
